Buying a property in Spain does not necessarily mean travelling to Spain for every stage of the process. For international buyers who live abroad or cannot easily travel, it is possible in many cases to arrange a property purchase remotely by granting a power of attorney (poder notarial) to a trusted representative in Spain. However, buying property remotely requires careful planning and independent legal advice.

Can you buy property in Spain without being there?

Yes. In many cases, a foreign buyer can complete a property purchase in Spain without being physically present at every stage. The buyer can grant a power of attorney authorising our lawyers or another trusted representative to act on their behalf. Depending on the powers granted, the representative may be able to carry out procedures such as reviewing documentation, signing certain contracts, dealing with the notary and completing the purchase. The exact scope of the power of attorney should be carefully considered before it is signed.

What is a power of attorney in Spain?

A Spanish power of attorney, or poder notarial, is a legal document that allows another person to act on your behalf. For a property purchase, it can be drafted specifically for the transaction. This means that the buyer does not necessarily have to give their representative unlimited authority. Our lawyers can advise on which powers are actually required and ensure that the document reflects the buyer's interests. International buyers may be able to grant the power of attorney before a Spanish notary or, depending on their country of residence, before a local notary following the appropriate legalisation or apostille requirements.

What can a lawyer do on your behalf?

The exact powers will depend on the document, but a lawyer acting under a properly drafted power of attorney may assist with different stages of the purchase, including:

  • Reviewing the property's legal documentation
  • Checking ownership and registered charges
  • Reviewing or negotiating the purchase contract
  • Liaising with the seller, estate agent and other professionals
  • Coordinating with the Spanish notary
  • Signing the final purchase deed when authorised
  • Completing registration with the Land Registry
  • Assisting with certain tax and administrative formalities

This can make the process considerably easier for buyers who live outside Spain.

Do you still need legal checks if you are buying remotely?

Absolutely. In fact, legal due diligence becomes particularly important when buying property remotely because the buyer may not be able to inspect the documentation or deal directly with the different professionals involved in the transaction. Before signing a contract or paying a substantial deposit, a lawyer should check matters such as:

  • Who legally owns the property
  • Whether there are mortgages, liens or embargoes
  • Whether property taxes and community fees are up to date
  • Whether the property complies with planning and building regulations
  • Whether there are restrictions affecting the property
  • The legal and financial terms of the purchase contract

The aim is to identify potential problems before the transaction becomes difficult or expensive to reverse.

Can you sign the purchase deed without travelling to Spain?

In many cases, yes. If the buyer has granted an appropriate power of attorney, their authorised representative can appear before the Spanish notary and sign the purchase deed on their behalf. The buyer can therefore complete the transaction without personally attending the signing, provided that the necessary legal requirements have been met and the power of attorney covers the required actions.

Buying property in Spain remotely: why independent legal advice matters

Buying a property abroad involves significant financial commitments. When the buyer is not physically present in Spain, having an independent lawyer acting on their behalf can provide an additional layer of protection. Independent legal advice for property purchases in Spain can help coordinate the transaction, review the legal documentation and ensure that the buyer understands the implications of the agreements they are signing. At Del Río Abogados, we assist international clients who wish to buy property in Spain, including buyers who are unable to travel to Spain during the purchasing process.
